These Terms and Conditions (“Terms”) govern your use of the InList website, mobile application, services, bookings, and communications provided by THE 007 PERCENT INLIST LLC DBA INLIST (“InList,” “we,” “us,” or “our”).
By accessing or using InList, creating an account, making a booking, or otherwise using our services, you agree to these Terms.

InList Services
InList provides access to services, experiences, events, reservations, bookings, and related offerings made available through the InList website and mobile application.
Availability of services, experiences, reservations, and events is subject to change without notice. InList reserves the right to modify, suspend, or discontinue the availability of any experience, event, service, or booking opportunity offered through its website or mobile application.
Event, venue, host, and experience information is provided based on the information available to InList and may be subject to change.

Hosts, Venues, and Third-Party Services
InList assumes no liability for the use or consumption of services, experiences, or events supplied by independent hosts, venues, or third-party providers listed through the InList platform.
Users are responsible for reviewing the relevant experience, host, venue, and applicable conditions before completing a booking.
Hosts and venues are responsible for determining whether bookings are appropriate and for delivering the services or experiences they provide.
InList is not responsible for changes made by independent hosts, venues, event organizers, or other third-party providers.

Availability and Bookings
All bookings, reservations, experiences, and events are subject to availability.
InList does not guarantee that a requested service, reservation, experience, or event will remain available until a booking has been confirmed.
InList reserves the right to disable future bookings for any experience, event, venue, or service on its website or mobile application.
Booking cancellations may not be accepted after the applicable cancellation or cut-off time established for the relevant reservation, event, or experience.

Pricing and Payments
Prices displayed through InList may be subject to change based on availability, venue or host requirements, applicable taxes, fees, and other relevant factors.
Prices listed in currencies other than U.S. dollars may be subject to minor changes resulting from international currency exchange rates.
Users are responsible for applicable local taxes, tariffs, charges, or other obligations associated with their purchases or use of services.
Where funds have already been transferred to a venue, host, event organizer, or other third-party provider, refunds may be subject to that provider’s applicable terms and policies.

SMS/Text Messaging Program
InList offers SMS/text messaging communications to users who provide a mobile telephone number and provide the applicable consent.
Depending on the consent provided, InList’s SMS program may include the following types of messages:
Reservation and Account Messages: InList may send non-marketing text messages regarding reservations, booking confirmations, booking updates, reminders, cancellations, account activity, customer service requests, concierge requests, and other service-related communications.
Marketing and Promotional Messages: If you separately opt in to marketing SMS communications, InList may send text messages regarding promotions, events, experiences, offers, announcements, invitations, and other InList products or services.
Consent to receive marketing or promotional SMS messages is not a condition of purchase.
Message frequency varies depending on your account activity, reservations, requests, and marketing preferences.

SMS Consent
By providing your mobile number and opting in to SMS communications, you represent that you are the subscriber or authorized user of the telephone number provided and that you consent to receive the applicable categories of text messages from InList.
Consent to receive reservation/account-related messages and consent to receive marketing/promotional messages may be collected separately.
Your consent to receive marketing SMS messages is voluntary and is not required to purchase products or services from InList.

SMS Opt-Out — Reply STOP
You may opt out of SMS communications at any time by replying STOP to a text message from InList.
After you text STOP, you may receive a confirmation message acknowledging your opt-out. After your opt-out request has been processed, you will no longer receive SMS messages covered by that consent unless you subsequently opt in again.

SMS Message and Data Rates
Message and data rates may apply to SMS messages sent to or received from InList.
Any messaging or data charges are determined by your wireless carrier and mobile service plan. InList is not responsible for charges imposed by your wireless carrier.
Message frequency varies.

Carrier Liability
Wireless carriers are not liable for delayed or undelivered messages.
Delivery of SMS messages is subject to effective transmission by your wireless service provider and network operator. InList cannot guarantee that every text message will be delivered or received within a particular timeframe.

SMS Age Restriction
InList SMS/text messaging services are intended only for individuals who are 18 years of age or older.
By opting in to receive SMS communications from InList, you confirm that you are at least 18 years old and are authorized to provide the mobile telephone number submitted.

SMS Privacy
Information collected in connection with our SMS program is handled in accordance with the InList Privacy Policy.
SMS consent and phone numbers collected for SMS communications will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

Email and Marketing Communications
Users may receive newsletters, marketing emails, promotional communications, or other electronic communications when they have provided the applicable consent.
You may unsubscribe from marketing emails at any time by using the unsubscribe link contained in the applicable email.
Certain transactional, account, reservation, security, or service-related communications may still be sent when necessary to provide requested services or administer your account.

User Responsibilities
By using InList, you agree to provide accurate information and to comply with applicable laws and regulations.
You are responsible for determining whether the services you purchase or use are permitted under the laws applicable to you.
You are also responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

User Content and Profiles
InList may allow users to create profiles and share information, messages, photographs, videos, and other content with other users.
You are responsible for the information and content you choose to share.
Although InList may provide privacy and account controls, InList cannot control how other users may use information that you voluntarily share with them.

The InList website or application may contain links to third-party websites, venues, payment providers, event organizers, or other external services.
InList is not responsible for the content, privacy practices, availability, or operation of third-party websites or services.

Limitation of Liability
To the extent permitted by applicable law, InList is not responsible for losses, damages, delays, cancellations, changes, or other issues caused by independent venues, hosts, event organizers, service providers, telecommunications providers, or other third parties.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

Changes to These Terms
InList may update these Terms periodically to reflect changes to our services, business practices, legal requirements, or communication programs.
The updated version will be posted with a revised “Last Updated” date.
Your continued use of InList after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

Governing Law
These Terms are governed by and interpreted in accordance with the applicable laws of the State of Florida, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.
